Justice Marialyn Barnard was appointed to the Fourth Court of Appeals on January 1, 2009. Raised in a military family, Justice Barnard attended elementary and high school in San Antonio, Texas. In 1983, Justice Barnard graduated from Texas A&M University Commerce, receiving a Bachelor of Science, Political Science and English degree. She is a former teacher and social worker. Justice Barnard received her juris doctorate from St. Mary's University School of Law in 1992.

Upon receiving her juris doctorate, Justice Barnard served as a briefing attorney and federal law clerk for Judge Orlando Garcia before practicing with the United States Attorney's Office. Justice Barnard was a managing director in forensic litigation for KPMG, LLP, conducting corporate investigations and compliance reviews. Justice Barnard also was a corporate attorney and director of business intelligence for CPS Energy. Prior to her appointment to the Fourth Court, Justice Barnard was practicing law with Prichard Hawkins McFarland & Young LLP, concentrating in the areas of business litigation and appeals.

Justice Barnard is a former director of the Bexar County Women's Bar Association and has been active in many local organizations, including Big Brothers and Big Sisters and Child Advocates of San Antonio. Justice Barnard has volunteered with San Antonio Metropolitan Ministries, the CPS Energy Weatherization program, and Habitat for Humanity. Justice Barnard also has served as a director on the Firstmark Credit Union Board and the Northeast Independent School District Academy for Creative Education Advisory Board. Justice Barnard is married to Dr. Gary Barnard. They have two children and one grandchild.
